现行企业所得税规定允许扣除的公益、救济性的捐赠，是指纳税人通过中国境内非营利的社会团体、国家机关向教育、民政等公益事业和遭受自然灾害的地区、贫困地区的捐赠。纳税人直接向受赠人的各项捐赠，不允许在企业所得税前扣除。

二、允许10%比例扣除

《财政部国家税务总局关于宣传文化增值税和营业税优惠政策的通知》(财税[2006]153号)规定：自2006年1月1日起至2010年12月31日，对企事业单位、社会团体和个人等社会力量通过国家批准成立的非营利性的公益组织或国家机关对宣传文化事业的公益性捐赠，经税务机关审核后，纳税人缴纳企业所得税时，在其年度应纳税所得额10%以内的部分，可在计算应纳税所得额时予以扣除

准予扣除的公益、救济性捐赠，有规定比例的，其限额的计算方法如下： 1、允许扣除的公益、救济性捐赠扣除限额=企业所得税纳税申报表主表第16行“纳税调整后所得”×3%(金融企业按1.5%计算；符合文化事业条件的公益救济性捐赠按10%计算)。

2、实际捐赠支出总额=营业外支出中列支的全部捐时支出

值得注意的是：某一纳税人只有一项公益救济性捐赠时，其实际捐赠额小于捐赠扣除限额，税前应按实际捐赠额扣除，无纳税调整额；如实际捐赠额大于或等于捐赠扣除限额时，税前按捐赠扣除限额扣除，超过部分不得扣除，超过部分即为纳税调整额。如果某一纳税人同时有几项公益救济性捐赠，或有在税前允许全额扣除的公益救济性捐赠，这时的“实际允许扣除的公益救济性捐赠额”，应该是某项捐赠扣除限额与允许全额扣除的公益救济性捐赠额之和。但税务机关查补的应纳税所得额，不得作为所属年度计算公益、救济性捐赠税前扣除的基数。
