第一条为加强建筑工程勘察设计质量监督与管理，保护国家财产和人民生命安全，维护社会公众利益，做好建筑工程施工图设计文件（以下简称施工图）审查工作，根据《建设工程质量管理条例》，制定本办法。

第二条施工图审查是政府主管部门对建筑工程勘察设计质量监督管理的重要环节，是基本建设必不可少的程序，工程建设有关各方必须认真贯彻执行。

第三条国务院建设行政主管部门负责全国的施工图审查管理工作。省、自治区、直辖市人民政府建设行政主管部门负责组织本行政区域内的施工图审查工作的具体实施和监督管理工作。

第四条本办法所称施工图审查是指国务院建设行政主管部门和省、自治区、直辖市人民政府建设行政主管部门，依照本办法认定的设计审查机构，根据国家的法律、法规、技术标准与规范，对施工图进行结构安全和强制性标准、规范执行情况等进行的独立审查。

第五条建筑工程设计等级分级标准中的各类新建、改建、扩建的建筑工程项目均属审查范围。省、自治区、直辖布人民政府建设行政主管部门，可结合本地的实际，确定具体的审查范围。

第六条建设单位应当将施工图报送建设行政主管部门，由建设行政主管部门委托有关审查机构，进行结构安全和强制性标准、规范执行情况等内容的审查。第七条施工图审查的主要内容：

（一）建筑物的稳定性、安全性审查，包括地基基础和主体结构体系是否安全、可靠；（二）是否符合消防、节能、环保、抗震、卫生、人防等有关强制性标准、规范；（三）施工图是否达到规定的深度要求；（四）是否损害公众利益。

第八条建设单位将施工图报建设行政主管部门审查时，还应同时提供下列资料：（一）批准的立项文件或初步设计批准文件；（二）主要的初步设计文件；（三）工程勘察成果报告；（四）结构计算书及计算软件名称。

第九条为简化手续，提高办事效率，凡需进行消防、环保、抗震等专项审查的项目，应当逐步做到有关专业审查与结构安全性审查统一报送、统一受理；通过有关专项审查后，由建设行政主管部门统一颁发设计审查批准书。

第十条审查机构应当在收到审查材料后20个工作日内完成审查工作，并提出审查报告；特级和一级项目应当在30个工作日内完成审查工作，并提出审查报告，其中重大及技术复杂项目的审查时间可适当延

施工图审查批准书，由省级建设行政主管部门统一印制，并报国务院建设行政主管部门备案。第十一条施工图审查报告的主要内容应当符合本办法第七条的要求，并由审查人员签字、审查机构盖章。

第十二条凡应当审查而未经审查或者审查不合格的施工图项目，建设行政主管部门不得发放施工许可证，施工图也不得交付施工。

第十三条施工图一经审查批准，不得擅自进行修改。如遇特殊情况需要进行涉及审查主要内容的修改时，必须重新报请原审批部门，由原审批部门委托审查机构审查后再批准实施。

第十四条建设单位或者设计单位对审查机构作出的审查报告如有重大分歧时，可由建设单位或者设计单位向所在省、自治区、直辖市人民政府建设行政主管部门提出复查申请，由省、自治区、直辖市人民政府建设行政主管部门组织专家论证并做出复查结果。

第十五条建筑工程竣工验收时，有关部门应当按照审查批准的施工图进行验收。

第十六条建设单位要对报送建设行政主管部门的审查材料的真实性负责；勘察、设计单位对提交的勘察报告、设计文件的真实性负责，并积极配合审查工作。

建设行政主管部门对在勘察设计文件中弄虚作假的单位和个人将依法予以处罚。第十七条设计审查人员必须具备下列条件：

（一）具有10年以上结构设计工作经历，独立完成过五项二级以上（含二级）项目工程设计的一级注册结构工程师、高级工程师，年满35周岁，最高不超过65周岁；（二）有独立工作能力，并有一定语言文字表达能力；（三）有良好的职业道德。

上述人员经省级建设行政主管部门组织考核认定后，可以从事审查工作。

第十八条设计审查机构的设立，应当坚持内行审查的原则。符合以下条件的机构方可申请承担设计审查工作：

（一）具有符合设计审查条件的工程技术人员组成的独立法人实体；（二）有固定的工作场所，注册资金不少于20万元；（三）有健全的技术管理和质量保证体系；

（四）地级以上城市（含地级市）的审查机构，具有符合条件的结构审查人员不少于6人；勘察、建筑和其他配套专业的审查人员不少于7人。县级城市的设计审查机构应具备的条件，由省级人民政府建设行政主管部门规定。

第十九条符合第十八条规定的直辖市、计划单列市、省会城市的设计审查机构，由省、自治区、直辖市建设行政主管部门初审后，报国务院建设行政主管部门审批，并颁发施工图设计审查许可证；其他城市的设计审查机构由省级建设行政主管部门审批，并颁发施工图设计审查许可证。取得施工图设计审查许可证的机构，方可承担审查工作。

首批通过建筑工程甲级资质换证的设计单位，申请承担设计审查工作时，建设行政主管部门应优先予以考虑。

已经过省、自治区、直辖市建设行政主管部门或计划单列市、省会城市建设行政主管部门批准设立的专职审查机构，按本办法做适当调整、充实，并取得施工图设计审查许可证后，可继续承担审查工作。第二十条施工图审查工作所需经费，由施工图审查机构向建设单位收取。具体取费标准由省、自治区、直辖市人民政府建设行政主管部门商当地有关部门确定。

第二十一条施工图审查机构和审查人员应当依据法律、法规和国家与地方的技术标准认真履行审查职责。施工图审查机构应当对审查的图纸质量负相应的审查责任，但不代替设计单位承担设计质量责任。施工图审查机构不得对本单位，或与本单位有直接经济利益关系的单位完成的施工图进行审查。审查人员要在审查过的图纸上签字。对玩忽职守、徇私舞弊、贪污受贿的审查人员和机构，由建设行政主管部门依法给予暂停或者吊销其审查资格，并处以相应的经济处罚。构成犯罪的，依法追究其刑事责任。

第二十二条城市市政基础设施工程的施工图审查工作，参照本办法执行。

铁道、交通、水利等专业工程的施工图审查办法，由国务院有关专业部门参照本办法制定，并报国务院建设行政主管部门。

第二十三条本办法自颁布之日施行。省、自治区、直辖市人民政府建设行政主管部门，可结合本地实际制定具体实施办法，并报国务院建设行政主管部门备案。
