经预见到患者可能出现的并发症。这里的预见是指患者的并发症是可以预见、或者完全应当预见到的。
其次，医疗机构有对患者及其家属的风险告知义务：也就是说，医疗机构是否已将可能发生并发症的情形告之患者，并取得患者及其家属的许可或者授权。前两项内容的实现可以通过手术前协议书、治疗风险告知书、病情告知书的形式来实现。
第三，医疗机构有对患者的风险避免义务：也就是说，医疗机构是否采取了相应的诊疗措施以尽可能避免并发症的发生。在患者手术后，按照诊疗常规医院都应当下手术后治疗医嘱、特护医嘱、特殊治疗方案等，这些都是积极避免治疗并发症的有效措施。也是要求医疗免责的条件之一。
第四，医院有对患者的医疗救治义务：也就是说，医疗机构是否采取积极的治疗措施以防止损害后果的扩大。
如果医疗机构在对患者的救治过程中，同时做好了以上四项，在诊疗的整个过程中诊断明确、及时；治疗系统、得当；对并发症采取积极的预防措施，出现并发症时积极对症处理，防止了损害后果的扩大，那么医疗机构可以主张不构成医疗事故、要求免除其法律责任。当然，判定的标准还是由医疗专家做出具体的判断！

4、不可抗力与意外事件
一般来说,把自然现象及战争、严重的动乱看成不可抗力事件，是世界各国一致的法理原则，我国《民法通则》和《合同法》均未将意外事件作为免责条件。因此，多数学者主张意外事件不应该作为免责事由。也就是说，医疗机构在医疗工作中非因“不可抗力”的原因，在治疗过程中出现没有预见到的意外事件，造成患者不良的损害后果的，不能够在法律上主张免除其责任。患者及其家属可以在医疗事故鉴定的过程中积极寻求有利的鉴定结论。
