第十三条 拆迁人委托拆迁的，应当向被委托的单位出具委托书，并订立委托拆迁合同。拆迁人应当自委托拆迁合同订立之日起15日内，将委托拆迁合同报城市房屋拆迁行政主管部门备案。
被委托的拆迁单位不得转让拆迁业务。
第十四条 拆迁人与被拆迁人应当就补偿方式、补偿金额、安置房屋的地点和面积、搬迁期限、搬迁过渡方式和过渡期限、违约责任以及当事人认为需要订立的其他事项，订立房屋拆迁补偿安置协议。
安置房屋为10层以下的，过渡期限不得超过2年;安置房屋为10层以上(含10层)的，过渡期限不得超过3年。
第十五条 拆迁租赁房屋属于下列情形之一的，拆迁人应当与被拆迁人、房屋承租人分别订立拆迁补偿安置协议：
(一)拆迁执行政府规定租金标准的公有住宅房屋，且被拆迁人选择货币补偿的;
(二)拆迁执行政府规定租金标准的私有住宅房屋的;
(三)拆迁按照国家落实私房政策带户返还住宅房屋的。

第十六条 拆迁人与被拆迁人或拆迁人、被拆迁人与房屋承租人在拆迁公告规定的拆迁期限内不能达成拆迁补偿安置协议的，当事人应当自拆迁公告发布之日起至拆迁期限届满之日前，向城市房屋拆迁行政主管部门申请裁决;城市房屋拆迁行政主管部门是被拆迁人的，由同级人民政府裁决。
裁决机关应当自收到申请之日起30日内作出裁决。
第十七条 当事人对裁决不服的，可以自裁决书送达之日起3个月内向房屋所在地的人民法院起诉。
