3、司法调解的优势与不足
司法调解的优势：
①调解人员的法律素质高，主持调解的法官具有专业的法律知识和丰富的审判经验;
②调解程序规范，诉讼法中一整套回避制度、举证制度等，调解法官都能熟练地运用到调解程序中去;
③调解的法律效力高，当事人对司法调解的认同度高。
司法调解的不足：
①调审结合的模式往往使同一审判人员兼作调解法官和裁判法官,法官为了提高办案效率，规避诉讼风险，在审理案件时往往会忽视调解的“自愿”原则,容易导致以压促调、以判促调、久调不决，从而损害了当事人的合法权益;

原则，混淆了判决与调解的界限。调解是当事人行使处分权、根据双方合意达成的一种诉讼契约，只要不违反法律的禁止性规定，不损害国家、集体和第三人的合法利益，就应当允许并赋予其法律效力。但现行民诉法却将调解与裁判一样设置了同样的前提条件，这为法官根据具体案情选择不同的诉讼阶段进行调解设置了障碍，不利于办案效率的提高和诉讼成本的减少。
