除斥期间，又称预定期间，是指某种权利的法定存续期间。二者区别在于：?
(1)诉讼时效由权利不行使的事实状态和法定期间的经过两个要件构成，而除斥期间只要一个要件，即法定期间的经过。?
(2)诉讼时效存在中断、中止和延长的可能，而除斥期间为法定的不变期间。?
(3)诉讼时效届满导致胜诉权消灭，而除斥期间的完成则导致权利本身的消灭。?
(4)除斥期间的起算点是该权利的取得，而诉讼时效期间则始于权利人知道或应当知道权利被侵害之日。
