第一章 总则

第一条 为规范我市的房屋建筑工程和市政基础设施工程验收及备案管理工作，明确其程序与内容，根据建设部《房屋建筑工程和市政基础设施工程竣工验收备案管理暂行办法》（建设部第78号令）、《房屋建筑工程和市政基础设施工程竣工验收暂行规定》（建建［2000］142号）、《广东省房屋建筑工程和市政基础设施工程竣工验收及备案管理实施细则（试行）》（粤建管字[2001]35号），结合本市实际，制定本办法。

第二条 在本市范围内新建、扩建、改建的房屋建筑工程、装修工程和城市道路、桥梁、隧道、地下铁路、给排水、燃气、绿化等市政基础设施工程（以下简称建设工程）的竣工验收及备案，适用本办法。

抢险救灾工程、临时性房屋建筑工程和农民自建低层住宅工程，不适用本办法。

第三条 未按规定的程序和内容进行竣工验收或者验收不合格的建设工程，不得交付使用。 第四条 广州市建设委员会负责全市建设工程竣工验收及备案的监督管理工作。

第五条 工程竣工验收备案由对工程实施质量监督管理的同级建设行政主管部门或其委托的机构（以下简称备案机关）负责办理。

第二章 工程施工质量验收

第六条 工程施工质量验收是指建设工程按报建审批、设计文件要求及合同约定的事项完工后，建设单位组织参建有关各方依照国家有关验收规范、标准，对工程施工质量进行的专项验收。该专项验收作为工程竣工验收前提条件之一，其作用等同于规划、环保和消防等专项验收。

第九条 监督机构对工程施工质量验收的组织形式、验收程序、执行验收标准等情况实施现场监督，并在受到《单位（子单位）工程质量验收记录》之后根据验收监督情况在5个工作日内向建设单位发出《建设工程施工质量监督意见书》。发现工程质量验收有违反国家法律、法规和强制性标准的或工程存在影响结构安全和严重影响使用功能隐患的，发出责令整改通知书，并将工程施工质量验收的监督情况作为《建设工程施工质量监督意见书》的重要内容。

第三章 工程竣工验收

第十条 工程竣工验收是指建设工程依照国家有关法律、法规及工程建设规范、标准的规定，已全部完成工程设计文件要求和合同约定的各项内容，建设单位已取得政府有关主管部门（或其委托机构）出具的工程施工质量、消防、规划、环保、城建档案等验收文件或准许使用文件，并编制完成《建设工程竣工验收报告》。

第十一条 建设单位全部取得工程施工质量、消防、规划、环保、档案等有关专业管理部门（或其委托机构）出具的认可文件或者准许使用文件后，应编制《建设工程竣工验收报告》。《建设工程竣工验收报告》一式五份，建设单位、施工单位、监督机构、备案机关及城建档案部门各持一份。

第十二条 监督机构对工程竣工验收的组织形式、验收程序、执行验收标准等情况实施监督，并在5个工作日内向备案机关提交《建设工程施工质量监督意见书》。发现工程竣工验收有违反国家法律、法规和强制性标准的或工程存在影响结构安全和严重影响使用功能隐患的，发出责令

第四章 工程竣工验收备案

第十三条 工程竣工验收实行备案制度。建设单位应当自工程竣工验收合格之日起15日内，依照有关规定，到备案机关办理备案手续。

第十四条 建设单位办理工程竣工验收备案按照下列程序进行：

（一）建设单位持有建设、勘察、设计、施工、监理等单位负责人、项目负责人签名并加盖单位公章的《建设工程竣工验收备案表》一式五份及下列文件，向备案机关申报备案： 1、建筑工程施工许可证； 2、施工图设计文件审查意见； 3、建设工程竣工验收报告； 4、工程施工质量验收申请表； 5、工程质量评估报告； 6、勘察文件质量检查报告； 7、设计文件质量检查报告；

8、单位（子单位）工程质量验收记录；

9、市政基础设施的有关质量检测和功能性试验资料； 10、工程施工质量验收监督意见书； 11、规划验收合格证；

12、建筑工程消防验收意见书； 13、环保验收文件；
